Personal injury
Louisville car accident lawyer.
Rear-ended on the Watterson, T-boned at a Dixie Highway light, hit by an uninsured driver on Bardstown Road. Justin Gooch handles the insurance companies, the no-fault paperwork and the claim against the driver who caused it.

After a wreck, the insurance company is already working. You should have someone working for you.
Within days of a collision the at-fault driver's insurer will call, sound helpful and ask for a recorded statement. Its job is to close the claim for as little as possible. Justin's job is the opposite: to document what the crash actually did to you and to make the insurer pay for all of it, not the part that is convenient.
How Kentucky car accident claims work
Kentucky is a choice no-fault state. Unless you rejected no-fault coverage in writing, your own policy's personal injury protection (PIP) pays your first medical bills and some lost wages regardless of who was at fault, typically up to a basic limit of $10,000. That is only the beginning. A claim against the at-fault driver for the rest of your medical care, your lost income, and your pain and suffering is separate, and Kentucky sets thresholds that must be met before that claim can be made. Justin sorts out which coverages apply and in what order.
Fault itself is decided under Kentucky's pure comparative fault rule. If you were partly to blame, your recovery is reduced by your share, but it is not eliminated. Insurers routinely inflate a claimant's share; the police report, the physical evidence and the witness accounts are how Justin pushes back.
Claims arising from a motor vehicle accident in Kentucky generally must be filed within two years of the accident or of the last PIP payment, whichever is later. Other injury claims can have as little as one year. Do not assume; ask.
What Justin does on a car accident case
- Locks down the evidence. The police report, 911 audio, intersection and business camera footage, vehicle damage photos and the other driver's insurance information. Footage is often overwritten within weeks.
- Handles every insurer. Your PIP carrier, the at-fault driver's liability carrier and, when the other driver has no insurance or too little, your own uninsured and underinsured motorist coverage.
- Builds the medical picture. Emergency care, imaging, specialists, physical therapy and the opinion of your treating doctors on what the future holds. The claim is worth what the medicine proves.
- Negotiates from strength. A demand backed by a complete file, and a lawsuit when the offer does not reflect the injury.
Common Louisville crash scenarios
Rear-end collisions in stop-and-go traffic on I-65 and I-264. Left-turn and red-light crashes at intersections along Dixie Highway, Preston Highway and Outer Loop. Distracted drivers on Bardstown Road and Shelbyville Road. Wrecks involving rideshare vehicles, where the insurance depends on what the driver was doing at the moment of impact. Hit-and-runs, where your own uninsured motorist coverage may be the only source of recovery. Justin has seen each of these many times and knows where the coverage hides.
What a car accident claim can include
Medical expenses past and future, lost wages and reduced earning capacity, the cost of repairing or replacing your vehicle, and compensation for pain, suffering and the ways the injury has changed daily life. When a crash is fatal, the family's claim is handled as a wrongful death case.
Common questions
Car accidents: what people ask first.
Should I see a doctor if I feel okay?
Yes, promptly. Soft-tissue injuries, concussions and disc injuries often show up days later. A gap between the crash and your first visit is the first thing an adjuster will use to argue the injury came from somewhere else.
The other driver had no insurance. Do I have a case?
Often, yes. If you carry uninsured motorist (UM) coverage on your own policy, it steps in for the at-fault driver. Underinsured motorist (UIM) coverage does the same when the other driver's limits are too low. Justin reviews your declarations page on the first call.
Do I have to use my own insurance if the crash was not my fault?
Under Kentucky no-fault, your own PIP coverage pays the first medical bills regardless of fault. That does not raise your rates for a crash you did not cause, and it gets treatment paid for while the liability claim is worked out.
How long does a car accident case take?
It depends on how long your treatment takes; a claim should not be settled until your doctors know what your recovery looks like. Straightforward cases resolve in months. Cases with serious injuries or disputed fault take longer, especially if a lawsuit is needed.
Hurt and not sure what to do next?
Call Justin. The consultation is free, and injury cases are handled on contingency.
